DIVORCE
Going through a divorce could be one of the most difficult and stressful experiences that you, your spouse, and your children will ever face. LEGAL SEPARATION
Hoggatt Law will advise you about the differences between physical separation and legal separation and the differences between legal separation and divorce (now called “dissolution of marriage†in Colorado). Hoggatt Law will also assist you by drafting separation agreements and by representing you in legal separation actions.
CHILD CUSTODY AND VISITATION
Child custody is now called “parental responsibilities.†Visitation is now called “parenting time.†These issues are often the most difficult and stressful issues to deal with. A Child and Family Investigation or a Parental Responsibilities Evaluation may be conducted as a part of the process. Hoggatt Law will assist you by seeking parental responsibilities and parenting time that is in the best interests of your children while protecting your parental rights.
CHILD SUPPORT
Hoggatt Law will assist you in obtaining child support, enforcing child support orders, or modifying child support orders if the circumstances have changed.
MAINTENANCE
Maintenance was formerly called “alimony.†Hoggatt Law will assess whether maintenance is likely to be ordered by the court. That assessment may include a vocational evaluator to determine the earnings or earning capacity of the spouse. If a request for maintenance is warranted, then Hoggatt Law will assist you by seeking maintenance on your behalf.
DIVISION OF ASSETS AND DEBTS
Assets and debts acquired during the marriage are “joint property†and are subject to “equitable division.†Equitable means fair – not necessarily equal. Property acquired before the marriage and property inherited during the marriage are “separate property†and are not subject to division; however, the appreciation in value of separate property during the marriage is considered to be joint property that is subject to division. The parties, after separation, often have wildly divergent views on the values of the property in their respective possessions. Appraisals, valuations, and expert opinions may be required if significant assets are involved. Hoggatt Law will assist you in the valuation process and by negotiating and structuring an appropriate division of assets and debts.
POST DECREE ENFORCEMENT
If existing court orders are not being complied with, then Hoggatt Law will assist you by seeking court enforcement of the orders.
MODIFICATION OF ORDERS
If circumstances have changed since your divorce or court orders, then you might be entitled to modify the existing parental responsibilities, parenting time, child support, or other orders. Hoggatt Law will assist you in evaluating the change in circumstances and by seeking modification of the existing orders if warranted.
